I am Kuljeet Singh Sachdeva, a Business Advocate and Commercial Mediator with over 19 years of experience in commercial disputes, strategic payment recovery, and insolvency actions. I have appeared before the Supreme Court of India, various High Courts, NCLAT, Commercial Courts, and District Courts, representing businesses in complex litigation and recovery proceedings.

Ans: The enterprise should have Udyam Registration at the time of the transaction for claiming benefits under the MSMED Act, 2006. Several courts have held that MSME registration cannot be applied retrospectively to claim the benefits of the Act. However, there have been conflicting judicial views in certain cases. Therefore, as a matter of legal prudence, the supplier should ensure that Udyam Registration exists before the supply of goods or services and before raising the invoice.
Ans: Yes. A written purchase order or work order strengthens the claim. If the order was oral, the supplier should submit an affidavit confirming the oral purchase order.
Ans: No. The supplier should also have delivery proof, such as delivery challans, transporter receipts, goods acknowledgment, or email confirmation.
Ans: Yes. Filing in the wrong state MSEFC may delay or complicate the proceedings. Jurisdiction is usually based on the supplier’s registered office, branch office, or place of transaction.
Ans: Yes. Many MSMEs treat Samadhaan as a simple complaint portal, but it is actually a legal arbitration process that requires proper documentation and strategy.
